MANILA, Philippines – Fresh off her dismissal as Mayor of Bamban, Tarlac, legal battles pile up on Alice Guo as she is set to face a tax evasion case over the alleged failure to pay P500,000 in capital gains taxes for the supposed sale of her property that became the location of raided offshore gaming operator facilities in her town. 

The case was filed by the Bureau of Internal Revenue against the dismissed mayor Wednesday  in connection with the transfer and sale of her shares in Baofu Land. This comes on top of her human trafficking case for criminalities busted in the sprawling POGO hub standing her property as well as the warrant of arrest served by the Senate for her continuous absence in inquiries. 

Among the respondents were Jack Uy and Rachelle Carreon of Baofu Land Development Inc. said to be the registered owner of a 7.9-hectare property in the province. 

In the complaint, Uy was identified as the “buyer” of Guo’s shares, while Carreon was Baofu’s corporate secretary.

BIR Commissioner Romeo Lumagui Jr. on Wednesday who filed the case at the Department of Justice said the transfer of shares to a certain Jack Uy had no capital gains tax and documentary stamp tax violating the National Internal Revenue Code, particularly Section 254 (attempt to evade or defeat tax), Section 255 (failure to file CGT and DST returns), and Section 250 (failure to file/supply certain information).

“Because it appears that the taxes were not paid, on record, [Guo] should still be the owner [of Baofu and she should pay the tax,” he told reporters at the DOJ. 

If the tax evasion case remains unsettled, Lumagui said the BIR would have to file another case. The bureau, he said, is also auditing other transactions involving the dismissed city chief and Baufu. 

“[We are] still looking at what else we can pursue from her,” Lumagui said. 

“Based on documents, the sale of the shares is low and does not seem to be matched with the properties owned by Baofu Corp. That’s one of the aspects we’re looking at in our audit and investigation, he said.
